Joshua Homme & Scott Reeder File Federal Lawsuit vs. Kyuss Lives!

Kyuss members Scott Reeder and Joshua Homme have been forced to file a federal lawsuit against John Garcia and Brant Bjork a/k/a Kyuss Lives! The suit alleges trademark infringement and consumer fraud by Kyuss Lives!

Quote from Reeder and Homme is below.

"It sucks. To think we went to a meeting in January solely to help them with their request to continue Kyuss Lives! With open arms, we made every attempt to help them continue Kyuss Lives! respectfully. Only to discover while they looked us in the eye, Kyuss Lives! management and band had filed federal documents in 2011 in an attempt to steal the name Kyuss.

This is desperately what we were trying to avoid. It's a sad day for us and for John - but most of all for the fans. What a needless mess."

So this is what Scott was referring to in a recent Facebook post about having an up and down day (the up being he got a new bass delivered).

WTF? Josh makes millions with his projects, Scott was asked to fill in and play with Kyuss when Nick wasn't able to plus he's a pretty successful studio producer. I don't get it.

Sounds like there was no real problem with "Kyuss Lives", but John/Brant were trying to trademark "Kyuss" for themselves. I dont agree with that.

This COMPLETELY fucking blows. Christ I was looking forward to hearing a new album, even without Homme. I wonder how fucked the whole thing is going to be now as a result of this...

Sorry to hear about that, Scott.
But sometimes an obvious solution to an already amenable situation needs to be presented by lawyers.

I have a hard time believing that the other parties couldn't have seen this one coming, but that certainly doesn't mean they did.

Best wishes, from here it sounds like you and Josh are very much in the right.

Time ago I had the pleasure of interviewing the owner of a studio who has collaborated with John Garcia for a project and appeared with Mad City Rockers, a job very dense and interesting, the same producer said he also organized a show with Brant Bjork & the Bros. I was very intrigued and he confirmed the openness of these characters, I wanted to continue the phone interview yesterday, was impressed by this story. He said: "I find it unlikely to be such a thing happened, these are lovely musicians, the money, the reward for them was never a problem and I am sure that there was some misunderstanding, Josh many times said to have closed with the past. I am not surprised at the statements of Scott and I think it is a fortune he's within the story, is a wonderful person and will certainly help to find the right solution, josh is too rude, Brant is just a free man who believed very much in the music, John loves his family, I hope soon to see an end this story, in the best way"

This is totally giving me Pink Floyd Roger Waters vs. David Gilmour flashbacks. That's not a good thing. Don't wait 'til Live Aid 2025 to sort this shit out.

Given that I am sure Homme was asked to be a part of this Kyuss (Lives) reunion and declined, I dont see why he should have a huge issue if they wanted to use the name. Legacy?...not band legacy, imo...Kyuss Lives affects the legacy just as much as it would if they went by Kyuss. I guess his legacy in relationship to Kyuss is affected to a degree, but probably more to him than anyone else.

I get Reeder's stance here since it doesn't sound like he was offered the opportunity to be apart of the reunion.

That said, end of the day, if an agreement was reached that Kyuss was off limits than Garcia and Bjork should have left it alone.

Wow. All these years, and I never knew it was pronounced "hommie". I always thought it was "hom".
I was never much of a Josh fan, though.
